Client Privacy Notice

This notice informs you about the processing of your personal data (including health data) in connection with your participation in the Metabolic Balance® nutrition program and about your rights as a data subject. The joint controllers for this processing are Metabolic Balance Global AG, Feringastraße 6, D-85774 Unterföhring, Germany, and the National Licence Holder (NLH) and, where applicable, the Executive responsible for your coach. Their contact details will be provided to you upon request at dp@metabolic-balance.com. They work closely together under the Metabolic Balance® program and are jointly responsible for protecting your personal data. Processing takes place across various systems and processes, with the Metabolic Balance® web portal operated solely by Metabolic Balance® Global AG. The responsibilities of each party are defined in a joint controllership agreement pursuant to Art. 26 GDPR, particularly with respect to data subject rights and legal obligations. You may exercise your rights with either controller; however, data access requests are generally handled by Metabolic Balance Global AG. Processing of personal and health-related data is essential for participation in the Metabolic Balance® program and for preparing your personalized nutrition plan. Data is collected by your coach and transmitted to Metabolic Balance® Global AG for further processing. You may also voluntarily register for the health newsletter (email-based), which is sent by Metabolic Balance® Global AG following a double opt-in process. With your consent, your data may also be used for analysis, product development, quality control, security improvements, and internal studies by the Metabolic Balance® Group.

The following categories of data are processed: full name, gender, date of birth, address, phone number, physical measurements, health and nutrition information (e.g. medical conditions, allergies, medications), blood values, voluntarily provided information (e.g. profession, title), and payment details. The legal basis for processing these data for program participation, marketing, and analytical purposes is your consent in accordance with Art. 6(1)(a) and Art. 9(2)(a) GDPR. 

You may voluntarily consent to being contacted with personalized information and offers. This allows the joint controllers to contact you, for example, with periodic newsletters, information about the Metabolic Balance nutrition concept, the company itself, the services and products offered by Metabolic Balance, as well as innovations, devices and applications in the health sector. This consent also includes tracking of newsletters in order to optimally personalize future mailings and offers for you. You can withdraw this voluntary consent at any time with effect for the future, without giving any reason. Withdrawal does not affect the lawfulness of processing carried out before withdrawal. 

You may also voluntarily consent to pseudonymised data analysis. This allows your data to be used additionally for analysis purposes, product improvement, quality control, security optimisation and internal studies by Metabolic Balance Global AG. Pseudonymisation is carried out in such a way that no direct inference to your person is possible without additional information. No merging with other data or use for advertising purposes takes place. You can withdraw this voluntary consent at any time with effect for the future, without giving any reason. Withdrawal does not affect the lawfulness of processing carried out before withdrawal. 

Your personal data may be disclosed to processors acting on our behalf for the performance of the contract, such as IT service providers. All processors are bound by data processing agreements pursuant to Art. 28 GDPR. 

Your personal data will only be retained for as long as necessary to fulfill processing purposes or comply with legal retention periods. Data may be stored longer in cases of legal disputes or formal complaints (Art. 6 (1) (f) GDPR). If you withdraw your consent or request erasure, your data will be deleted or anonymized within 60 days, unless retention obligations apply. Otherwise, all data will be anonymized automatically after two years of inactivity. 

If personal data is transferred to recipients outside the EU, this is done only in accordance with Art. 44 et seq. GDPR, based on an adequacy decision or appropriate safeguards. In the absence of such, data will be transferred only with your explicit informed consent under Art. 49(1)(a) GDPR. 

Your Rights as a Data Subject

Under the GDPR, you have the right to access (Art. 15), rectification (Art. 16), erasure (Art. 17), restriction (Art. 18), data portability (Art. 20), and to object (Art. 21) to the processing of your personal data. You may withdraw consent at any time with future effect by emailing dp@metabolic-balance.com. Separate consents may be withdrawn individually. Withdrawal does not affect the lawfulness of processing prior to its receipt. Automated decision-making or profiling does not take place.

You also have the right to lodge a complaint with the competent data protection authority. For Metabolic Balance Global AG, the competent authority is: Bavarian State Office for Data Protection Supervision (BayLDA), P.O. Box 1349, D-91504 Ansbach, Germany. 

This privacy notice may be updated to reflect legal changes. We will inform you appropriately of any such changes. Should any provision of this notice be invalid, the validity of the remaining provisions shall remain unaffected. German law applies, excluding the UN Convention on Contracts for the International Sale of Goods.
