Privacy Notice on the Use of the App

The protection of your personal data is of great importance to us. The processing of your personal data is carried out solely in accordance with the applicable legal provisions, in particular the General Data Protection Regulation (GDPR) and the German Federal Data Protection Act (BDSG). This Privacy Notice informs you about the type, scope, and purposes of the processing of your personal data in connection with the use of the Metabolic Balance App (“App”). The controller responsible for data processing is Metabolic Balance® Global AG, Feringastraße 6, D-85774 Unterföhring, Germany. When using the App, we only process personal data that you provide to us during registration and use of the App, in particular to provide your individual nutrition plan. This also includes health data, meaning information relating to your physical or mental health. Such data may include your name, email address, postal address, date of birth, telephone number, responses to health-related questions, medical test results (e.g. blood values), weight, password, device ID, Google ID, or Apple ID. The legal basis for processing personal data is Article 6(1)(b) GDPR; for health data, Article 6(1)(a) in conjunction with Article 9(2)(a) GDPR. 

For the purpose of analysing and improving the App, we use certain data in anonymised form, which does not allow any inference to your identity. To this end, personal identifiers are replaced with an internal ID, and the data is evaluated on an aggregated basis. The legal basis for this processing is your explicit consent under Article 6(1)(a) in conjunction with Article 9(2)(a) GDPR. 

Recipients of your data are exclusively IT service providers involved in the operation of the App. No further transmission of your data takes place. Data is stored only for as long as required for the respective purposes and as permitted by statutory retention periods. In the event of complaints or legal disputes, data may be stored for a longer period. If you withdraw your consent or request deletion, your data will be deleted within 60 days, provided that no legal obligation to retain it exists. Without a deletion request, data will be deleted after two years of inactivity. 

A transfer of data to a third country will only take place in compliance with the GDPR (Articles 44 et seq.), for example on the basis of an adequacy decision or appropriate safeguards. Otherwise, such transfer will only occur with your explicit and informed consent in accordance with Article 49(1)(a) GDPR. 

 

You have the right to request information in accordance with Article 15 GDPR regarding the personal data we process, including the purposes of processing, categories of data, recipients, storage period, and your rights to rectification, erasure, restriction of processing, objection, the origin of the data, and the existence of automated decision-making including profiling. You further have the right to rectification of inaccurate data (Article 16 GDPR), erasure (Article 17 GDPR), restriction of processing (Article 18 GDPR), and data portability (Article 20 GDPR). 

You may withdraw your consent at any time pursuant to Article 7(3) GDPR, for example by emailing dp@metabolic-balance.com or by deleting your account in the App. The withdrawal takes effect for the future only and does not affect the lawfulness of processing based on consent before its withdrawal. You also have the right to lodge a complaint with a supervisory authority under Article 77 GDPR. The competent authority is: Bavarian State Office for Data Protection Supervision (BayLDA), P.O. Box 1349, D-91504 Ansbach, Germany. 

The Metabolic Balance App is provided free of charge via the Apple App Store and Google Play Store. By registering in the App, you confirm your acceptance of the Terms of Use and that you are at least 16 years old (or that you have the consent of your legal guardian). The App is intended for informational purposes within the framework of the Metabolic Balance nutrition programme and does not replace medical advice or treatment. Changes to the Terms of Use may be made when legally or technically necessary. Material changes require your explicit consent; if you decline, we reserve the right to terminate the contractual relationship. 

Prohibited uses of the App include, for example, hacking, spreading malware, using false identities, uploading unlawful content, reverse engineering, scraping, sharing access credentials, or commercial exploitation. You are responsible for maintaining the confidentiality of your access credentials. The App and its contents remain the property of Metabolic Balance Global AG. You are granted a non-exclusive, non-transferable, and revocable right of use for personal purposes only. 

The handling of your data is further governed by the Privacy Notice available at www.metabolic-balance.com/client-privacy-notice. Advertising and paid additional services may be offered. App updates may add or remove functionalities. You may terminate the usage agreement at any time by deleting the App. In the event of violations, we reserve the right to terminate the agreement without notice. 

The App is intended solely for general informational purposes; no liability is assumed for completeness or external links. We do not guarantee the availability, compatibility, or freedom from malware of the App. Unlimited liability applies only in cases of intent, gross negligence, injury to life, body or health, or where required by mandatory law. In cases of slight negligence, liability is limited to foreseeable, typical contractual damages. 

If individual provisions are or become invalid, the validity of the remaining provisions shall not be affected. German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). In case of discrepancies, the German version of the Terms of Use shall prevail www.metabolic-balance.com/de/app-datenschutzhinweise.
