App Privacy Notice

Protecting your personal data is important to us. The processing of your personal data is carried out exclusively in accordance with applicable legal regulations, in particular the General Data Protection Regulation (GDPR) and the German Federal Data Protection Act (BDSG). This privacy notice explains the nature, scope and purposes of the processing of your personal data in connection with your use of the Metabolic Balance App (“App”). We only process personal data that you provide when registering for and using the App, primarily to make your personalized nutrition plan available to you. This includes health-related data (special categories of personal data), such as your name, email address, postal address, date of birth, phone number, answers to health-related questions, medical test results (e.g. blood values), weight, password, device ID, and Google or Apple ID. The legal basis for processing is Art. 6(1)(b) GDPR for service provision, and your explicit consent under Art. 6(1)(a) in conjunction with Art. 9(2)(a) GDPR for processing health data.

 

To improve and further develop the App, we analyze anonymized usage data. Your identity cannot be inferred from this information. An internal ID is used to replace any personally identifiable information. The legal basis for this anonymized analysis is your consent pursuant to Art. 6(1)(a) and Art. 9(2)(a) GDPR.

You may subscribe to our newsletter within the App. A valid email address is sufficient for registration, and the double opt-in procedure is applied. The legal basis for processing is Art. 6(1)(a) GDPR. You can unsubscribe at any time using the link in each email. Upon withdrawal of consent, your email address will be deleted from the distribution list.

Your data is only shared with IT service providers who are essential for the operation of the App. No other disclosure takes place. Your personal data will be stored only as long as necessary for the respective purposes or as required by law. In individual cases, longer retention may be necessary in the event of complaints or legal claims. If you withdraw your consent or request deletion, we will delete or anonymize your data within 60 days unless retention obligations apply. Otherwise, your data will be anonymized automatically after two years of inactivity.

 

Data transfers to third countries outside the EU are only made in accordance with Art. 44 et seq. GDPR, for example based on an adequacy decision or appropriate safeguards. Otherwise, a transfer will only take place with your explicit informed consent in accordance with Art. 49(1)(a) GDPR.

You have the right to access your personal data (Art. 15 GDPR), including information on the purposes of processing, categories of data, recipients, storage periods, your rights, and whether automated decision-making including profiling is used. You also have the right to rectification (Art. 16), erasure (Art. 17), restriction of processing (Art. 18), and data portability (Art. 20). You may withdraw your consent at any time with future effect (Art. 7(3)), for example by email to dp@metabolic-balance.com or by deleting your account in the App. The lawfulness of processing prior to withdrawal remains unaffected. You also have the right to lodge a complaint with a supervisory authority (Art. 77). The competent authority for Metabolic Balance Global AG is the State Commissioner for Data Protection of Brandenburg, Stahnsdorfer Damm 77, D-14532 Kleinmachnow, Germany.

The Metabolic Balance App is available free of charge in the Apple App Store and Google Play Store. By registering, you confirm that you accept the Terms of Use and that you are at least 16 years old (or have parental consent). The App serves informational purposes only within the Metabolic Balance nutrition concept and is not a substitute for professional medical advice, diagnosis, or treatment. Changes to the Terms of Use may occur due to legal or technical reasons. Material changes require your explicit consent; if consent is not given, we reserve the right to terminate the contractual relationship.

 

Prohibited use of the App includes hacking, malware, false identities, unlawful content, reverse engineering, scraping, sharing of login credentials, or commercial use. You are responsible for maintaining the confidentiality of your login credentials. The App and its content remain the property of Metabolic Balance Global AG. You are granted a non-exclusive, non-transferable, revocable right to use the App for personal purposes only.

Updates may change or remove certain App features. You may terminate the user agreement at any time by deleting the App. We reserve the right to terminate the agreement without notice in the event of a breach. The App is for general informational use only; no liability is assumed for completeness or external links. No guarantee is given for availability, compatibility, or protection from malware. Liability is unlimited in cases of intent, gross negligence, or damage to life, body, or health, or where required by law. In the event of slight negligence, liability is limited to foreseeable and typical contractual damages.

If any provision is or becomes invalid, the validity of the remaining provisions remains unaffected. German law applies to the exclusion of the UN Convention on Contracts for the International Sale of Goods.
